Code of Conduct

Purpose of the Code of Conduct

The purpose of this Code of Conduct ("The Code") is to provide Members with guidance on the standards of behaviour expected of them in their membership of the North Shore Wind Symphony ("NSWS") and in their dealings with fellow Members. Adherence to The Code ensures that NSWS operates in a safe and positive environment for music making, encouraging mutual respect and professionalism. The Code is not intended to address specific situations that may arise with respect to what is acceptable and unacceptable behaviour.

The NSWS Executive Committee ("The Executive") may alter the Code at any time. Members must observe the Code as amended from time to time. Members will be notified of any changes via communications made to all NSWS Members.

Who the Code Applies To

The Code applies to all members of the NSWS including:

General Principles Guiding Members' Conduct

All Members have a responsibility to:

  1. Respect and uphold the reputation of the NSWS;
  2. Treat all other Members with fairness, courtesy, respect and without discrimination;
  3. Always act in a professional, responsible, and diligent manner;
  4. Give due respect to those NSWS Members in leadership roles within the ensemble eg. conductors and section leaders.

Standards to be Observed by Members

Members are expected to observe the following:

  1. Protect and respect the rights and reputations of other Members and the NSWS;
  2. Avoid behaviour that could reasonably be perceived as harassment, intimidation, discrimination on any basis, bullying or threatening in any way;
  3. Comply with any lawful and reasonable direction given by The Executive;
  4. Take reasonable steps to protect and not disclose confidential information;
  5. Demonstrate the highest professional and ethical standards;
  6. Use NSWS facilities, resources and information in a proper manner;
  7. Maintain and observe all safety and health procedures in the workplace. Members must not perform any act or omission which may cause injury or harm to any other person.

Discrimination

The NSWS complies with all appropriate Federal and State legislation in regard to discrimination.

Reporting Contraventions of the Code

All Members have a duty to report contraventions of the code as soon as practical to either:

A notification of a contravention can be expressed anonymously if desired and either verbally or in written form. If the notification is requested to be anonymous, The Executive member seeks to uphold the request.

After initially considering the notification, The Executive must:

  1. Notify the relevant Member(s) of the alleged contravention in writing, including the actions (or failure to take actions) that the alleged contravention relates to; and
  2. Invite the relevant Member(s) to attend the next available NSWS Executive meeting to explain and provide reasons for the actions (or failure to take actions) that resulted in the alleged contravention.

Actions Available to The Executive and/or Band Manager

After The Executive has considered the explanation and reasons for the actions (or failure to take actions) that have led to the alleged contravention, The Executive may decide to follow one or more of the following courses of action as a result of a contravention of The Code:

  1. No action;
  2. Communication from The Executive, which may include actions that the relevant Member(s) is required to take or stop taking within a specified period of time;
  3. Suspension of the relevant Member(s) from membership of or association with the NSWS for a specified period of time;
  4. Permanent disqualification of the relevant Member(s) from membership of or association with the NSWS; and/or
  5. Notification to the NSW Police or relevant organisation as decreed by the NSW Crimes Act.

For all courses of action described above, The Executive must provide written reasons within a reasonable time to the relevant Member(s) explaining why the relevant course of action was taken.
